This example opens actually a different question and that is the inferred type which is the intersection type of given one. In KeY 1.x we had intersection sorts to represent this kind of cases. They were introduced as a completeness necessity for the FOL fragment. In practice their existence was a bit of a pain as they were dynamically introduced and as the completeness issues in practice did not show up we eliminated them at some point. The question here is: Do we need them back?
